Terms of Use

These terms govern your use of alohalegacymusic.com (the “Site”), operated by Aloha Legacy Music LLC (“Aloha Legacy Music,” “we,” “us”). By using the Site you agree to them. If you do not agree, please do not use the Site.

The music belongs to its makers

The songs, recordings, lyrics, artwork, videos, photographs, text, and design on the Site are protected by copyright and other laws. They belong to Aloha Legacy Music LLC, to the artists who performed them, or to the clients who commissioned them, as the case may be.

You may listen to the music and view the content on the Site for your personal, non-commercial enjoyment. You may share links to the Site. You may not download, copy, record, re-upload, sample, remix, synchronize with video, perform publicly, sell, or otherwise use any song or recording from the Site without written permission from us. Requests for licenses, performances, or use in media are welcome at info@alohalegacymusic.com.

“Aloha Legacy Music” and our logo are our trademarks. Please do not use them without permission.

Commissioning a song

Sending a song request through the Site is the start of a conversation, not a contract. A commission begins only when we agree on it in writing, and that agreement will set out the price, the timeline, what you receive, and who owns what. Unless that agreement says otherwise:

• You may share your commissioned song privately and play it at personal and family events.
• Aloha Legacy Music and the performing artists retain the copyright in the composition and recording.
• We may feature the song on the Site or in our portfolio only with your permission.

What you send us

When you share a story, names, memories, or other material through the Site, you confirm that you have the right to share it, including any details about other people, and you give us permission to use it to write, record, and deliver your song and to communicate with you about it. Please do not send anything unlawful, defamatory, or that infringes someone else’s rights.

Using the Site

You agree not to interfere with the Site, attempt to access parts of it you are not authorized to use, scrape it, or use it for any unlawful purpose. Content editing tools on the Site are reserved for Aloha Legacy Music and its authorized team.

Links and embedded content

The Site links to and embeds content from other services, including YouTube and our sponsors’ websites. We do not control those services and are not responsible for their content or their terms.

No warranties

The Site and its content are provided “as is.” We work hard to keep the Site accurate and available but do not promise that it will be uninterrupted or error-free, or that the information on it is complete or current. Descriptions of our services on the Site are general; the terms of any commission are set in its written agreement.

Limitation of liability

To the fullest extent permitted by law, Aloha Legacy Music LLC, its members, employees, and artists will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Nothing in these terms limits liability that cannot be limited by law.

Governing law

These terms are governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought in the state or federal courts located in Honolulu, Hawaiʻi, and you consent to their jurisdiction.

Changes

We may update these terms from time to time. The date at the top of this page shows when they were last changed. Continued use of the Site after a change means you accept the updated terms.
